Ontario police investigate fatal truck accident

A serious crash on Highway 401 has left a truck driver dead, according to local sources. Ontario police are still in the process of investigating the cause of the accident, which reportedly involved two tractor-trailers and a minivan. So far, they have not chosen to file charges against any of the drivers involved.

The accident report states the crash took place just before midnight on the night of Oct. 25 on Highway 401 near Trafalger Road in Milton. Apparently, construction on the highway caused a line of trucks to slow down as a result of traffic backup. For reasons not yet understood, the driver of one truck slammed his vehicle into the back of another truck, causing serious damage to both vehicles. A minivan was also struck with debris from the initial crash.

The driver of the rearmost truck was killed in the impact. The driver who was struck was taken to a local hospital with injuries described as minor. No one in the minivan was hurt. Police still do not know whether the rearmost driver or the driver in front of him was materially responsible for the accident. Their investigation is ongoing at this time.

Depending on the outcome of the Ontario police investigation, several courses of action are available outside the realm of criminal charges. If it is determined that the front driver slowed down too quickly or otherwise caused the rear vehicle to strike him, that driver could face a wrongful death suit in civil court if the family of the deceased driver chooses to file one. If the rearmost driver is deemed responsible, the injured driver could file for personal injury against the other driver's estate.
