A woman is dead and her infant son is in critical condition following a serious crash on the night of Nov. 27. Ontario Provincial Police confirmed the 29-year-old woman perished in the car accident. The other driver involved in the crash is facing charges that include impaired driving. He was due in court in Kitchener on Nov. 28.
According to the police report, the accident occurred around 8 p.m. on Highway 7/8 near Trussler Road. The woman was a passenger in a vehicle that was also carrying her husband, mother-in-law and 2-month-old child. Apparently, the other driver, who may have been drunk at the time of the tragedy, rear-ended the vehicle.
The force of the impact caused traumatic injury to both the mother and child. They were rushed to hospitals in critical condition. The mother was later pronounced dead, and the child remains in critical condition at Sick Kids' Hospital. The mother-in-law and husband both suffered minor injuries.
If the 26-year-old driver suspected of drunk driving is found guilty, he could face serious jail time in connection with his role in this tragic car accident. Separately, the deceased victim's family is entitled under Ontario law to file wrongful death and personal injury suits against him in a civil court setting. Even if he is not convicted of the criminal charges, any police evidence pertaining to the case can be offered in civil court to support claims for monetary damages. Once liability is formally established, the court will consider documented claims for specified financial losses.
